The Seller and Buyer cannot and will not take any more abuse from Capital Consultant Management's Corporation and the HOA's Executive Board of Thugs. Please see BOD deed of transfers and voting results, public criminal record background information on some of the BOD and poll the homeowners at 5100 Verde Valley.
Don't forget to ask about the minutes they sent out with the bulk receipts that notified everyone that it is fair and square. Read the September minutes closely, if you can get a copy of them. Riddle and Williams has a copy and I do too. Maybe Mr. Blanton as well. That is only because he seconded something that no one will ever see again. I wonder what his dues are. Unless they show me the bulk mail receipts, I don't' believe lenders or homeowners have been notified on any thing, especially the latest instruments to the declaration.
But they did said they have a business line of credit of roughly $550,000, which is about what the original bid was in the first place. Something else that is bizarre, Rick Moore of CCMC and Kathy Mcwhorter, BOD Sec. of Treasury, both said that CCMC had nothing to do with an illegal siding project that was on going. I thought the Management Co. handles all the funds; that’s what it says on the seller’s original project questionnaire by Judy Dreis, and CCMC's website used to say CCMC believes in handling all the funds. But the one they would have had the buyer sign at closing- would have said they handle some of the funds. Slippery and Tricky.
The Lender told the qualified Buyer that the buyer would need a structural engineer report before they start the foundation work (of course, that way the foundation company would know what is wrong and how to fix it), otherwise that could lead to a building that is not structurally sound. A spokesperson from your office said you prefer to keep the matter private. I don't blame you; it was a task for The President Elect of the Dallas/Ft Worth CAI who happens to have 3 years as Director of Maintenance at CCMC. Well, Ron Stephens VP of CCMC and D/FW CAI President left the Buyer a message in late May or June (audio of CAI President's message can be provided upon request) that states he is aware of the June 19th closing and yes the steps do need to be replaced.
Following are the facts.
1. CCMC prepares everything for the criminals, I mean volunteers. Does the CAI website recommend I turn Ron Stephens, VP of CCMC, into the local CAI chapter where he is currently President?
Why doesn't your class mate Gregg Abbott, Senator, please see KTBC FOX 7 special report in Austin? You and David Gibbons and Riddle and Williams and yes it appears the State Attorney General are in on it as well. Are you Insane? Did you have a tree fall on you as well? Are you going to say I make false claims like your "UT connection" buddy as well? Why the OIG has not put you and David Gibbons Company on the all around (we will not take any of your unaudited financials on the HUD LDP list) amazes me. I am a concerned citizen just like the employees that work for you, Mr. Senator. You know the Associa employees of yours that lobby as private citizens.
By the way, I went to BL in East Dallas but I could never find those CAI trading cards, did Adams pharmacy carry those? I have become completely consumed and all wrapped up in the well planned evil that you and all your CAI buddies have been able to pull off so far. Type in Senator Carona’s name in Yahoo. The scandals are starting to mount. I use to underwrite FHA loans till 1992. The buyer’s contract was written in a way to where the buyer didn't have to question the integrity of the hand picked BOD by the CCMC President (Ex National CAI President).
Has no one done a study to see the percentage of foreclosures in CAI communities? Any way all the laws or the same except the Senator's legislation. So don't say it's to protect homeowners or purchasers. I know the top management of select lenders will always take your word on next year’s budget. Believe it or not, Countrywide didn't do that. As a matter of fact, according to my HUD friends, they have never seen a property get turned down every way you can. These are the facts: Ron Stephens VP of CCMC,CMCA,AMS,PCAM with Certified UT Connection Ex CAI President and CCMC President, I know I am leaving some letters out. Let's try SCAM. Alright Senator! What do the Buyer and seller get for playing the CAI Game? Let's have our special guest, I could give a rat’s assessment about The Buyer or seller’s rights, Mr. Abbott, come on down. Let's present the Facts.
June HOA meeting, Rick Moore, CCMC community mgr., and Ron Stephens, CAI President, act as though they have never heard about the foundation problem when my neighbor brought it up at the meeting, he would testify that he has been trying to get the gutters fixed for 5 years. He is also willing to talk to any media that chooses to ask him. We have witnesses.
2. Fox Foundation meets neighbor and Buyer and states that CCMC just told him to fix the steps, when asked if he thought there was foundation problems, he says "oh yea!” That was June 25th, he also said the gutters were the problem and Unit #111 is requiring an engineers report. I told Rick Moore at the April meeting I would pay for it. We have the report!
3. August 8th, Fox foundation is finally working on the foundation for June 19th closing. I sent Mr. Gibbons a letter about the terrible service, hostile board as well as the bizarre behavior of the BOD. We also were still asking for the financials but the BOD voted no, I can't see them. We have proof! No one could get the required FHA Doc's except William Toles, BOD President. Got his FHA loan too in September. WOW! Look under Dallas public records, Gibbons has an FHA loan as well! He has two owner occupied homes?
4. August 15, 2008--David Gibbons, CCMC President, and former national CAI president, sends buyer a most gracious apology letter that says "Please be advised that CCMC has no responsibility for your alleged claim and will not provide any remuneration to you". WHY NOT? The BOD told us to call Ron Stephens because the community mgr., Rick Moore, had already lied to us about the seller not knowing about it (foundation) and the service or lack of it was simply horrendous. But it is a good thing we have the local CAI president working hard for us. No one on the BOD or at CCMC MGT Co. thought to read the report and take care of the gutters or get an engineer's report. That is just insane!
5. August 11, 2008--Fox foundation -To All Interested Parties, RE: Foundation Repair Completion. Mike Fox states "It is still my opinion that the overflowing gutters and the sinking porches were the main cause of the movement. If the gutters are working correctly, the foundation should remain in its present condition. If you look at my pictures from February 10, 2009, or talk to my neighbor Dennis, one can clearly see they are not. Evidence upon request.
6. September 24th- Countrywide gets letter from CCMC-- I'm sorry the Board didn't engage an engineer for the foundation report. Gross negligence, that’s it! I am going to turn them into the CAI. Let’s see how they deal with it. The press will be watching! No conflict of interest, and out of all the scams Abbott puts on his website, nothing for crooked HOAs or Management company's in Texas, seems very odd!. This is all true because the lender and foundation report prove it. It wasn't that hard. The Management Company simply chose not to perform their duties, because they didn't feel like it. They should never ever have problems with providing Financials to a woman who has been on her job for over twenty years, good credit, buyer took out $30,000 from 401K to pay debt off so she could qualify, she did over and above what she was supposed to do and yet no sense of urgency from Bod or CCMC. We simply couldn't ever--not even once--get the BOD or Management Company to act reasonably or in the best interest in any instances—except, of course, to protect their interests.
7. Steve Stoler--Please look at www.youtube.com/watch Carona in Austin. I have unit #'s that will tell you they have been towed, fined for dish that wasn't there, that’s Harry in 160. He would love for you to come to the next meeting. I also have two people that did not get everything at closing.
8. September 26th--Countrywide sends buyer letter saying that the BOD and CCMC still have not fixed gutters, therefore, Buyer can't close by 30th to take advantage of seller assisted 3% program. I know its unbelievable!
9. I love this one--the seller pays $700 to another UT grad to get disclosure for buyer that she has already paid for and Nope! Can't have it! Why not? Just absurd the seller has to pay $700 for two UT grads to debate property code for buyer’s disclosure. CCMC already said the BOD voted and the buyer couldn’t have disclosure, awesome property management! This is the well planned out legislation of Carona with CAI attorneys Riddle and Williams. They hide behind the BOD’s broad powers, then Riddle and Williams will protect them so they can all continue to fleece some more.
Senator Carona, do you think a buyer is allowed to see any thing that is allowed by law? Seriously, how can the buyer make sure his or her investment is sound? This could be avoided, well not this HOA with the world's dumbest criminals.
Now you and I have noticed every one here is in the CAI. I don’t know about BOD President. The Buyer only knows that Mr. Toles got his FHA loan the same month that hers was denied. Somebody needs to pay her back and explain to the seller why the CCR's here are worthless--that would be at least 3 breaches off the bat. Seriously are these homeowner’s rights that you are providing? Well the Buyer only signed a contract to purchase, so I would think that she should be able to go look at every thing that is provided by law.
I think when the Buyer gets a letter from their lender saying the property is ineligible and the reason being CCR’s--that's right the whole thing. This State should investigate. The reason they don't is because of the "UT Connection". Senator I am going to include you along with all of your CAI buddies in my report to the OIG. By the way, this is what the letter from the Denver HUD office recommends. Once again, CCR's, spot loan approval, and the appraisal were all rejected. The appraisal is a no brainer Title 18! Federal violation, Criminal for CCMC and the BOD. Project is Red Flagged. FHA does say turn in people who you suspect of fraud. They have broke all business codes and Non-profit as well.
Well you can talk to the press, because you are one big conflict of interest and your classmate has knowingly violated federal law. Read the Appraisal before you talk to the OIG, I’m sure they have been waiting for this. I will be back with more truthful facts.
Everything I said is true because there is no way any of you (CAI) can prove otherwise. Wow! 12 jurors and the preponderance of the evidence. CCMC and their hand -picked BOD can not provide evidence to the Buyer and seller to prove otherwise. And we are not even done.
CCMC, you can run and blame it on the BOD, but it will not help now. This file is documented to the fullest. By the way, did you know I took a picture of every thing that was posted since Countrywide caught The BOD and CCMC? Yes the from CCMC I am just going to say CAI.Troop 5100 VERDE Valley. On the illegal siding scam, there wasn’t much, I'm sure the CAI management-lead coalition can prove everything was sent out. By the way, I suspect steering in that siding case as well, wouldn't that be great to have RICO with FBI and CAI and BOD with a previous board member. She drives the brand new JAG. She should really keep their voices down when they are having a few at Al's Hide Away. Have you noticed the new cars the BOD drive? Tough times didn’t affect them.
It's a shame Harry can't qualify for an FHA loan here any more, not just because the red flag. The assessments threw his income -debt ratio's out of whack. The posted minutes during the McWhorter Regime that changed daily. Yes the buyer has proof of that. Just ask our neighbor Carter and the tapes at the meetings that Sharon went to are Funny. But what the BOD did in collusion with the management company did is not. Are you all getting Vets rejected as well? I know this can't be the first time.. Oh! One other thing, the letter from The Denver Homeownership Center States appraisal. That was automatic, you cannot knowingly omit some things, and also other verbiage about the $700,000 loan with info provided by CCMC blew it wide-open. Then when asked for real financials with regard to any thing, they mean it.
The Spot-loan approval was rejected as well. No way they could do a sufficient analysis. Countrywide even sent Michele a copy of what they needed and man they went over and beyond. Well that is 2 Government forms with fraud. Ouch! I don't think they will be giving you and Mr. Gibbons the ole Hook em horn sign. They will investigate if you want them too. Time is running out! Maybe it's one heck of an anomaly like that Houston condo project. Did they get a structural engineer's report?
Senator, by the way, that other UT grad Abbott has a website for unscrupulous engineers. Maybe he will sue them like he is Countrywide. I think there is more to that than what was in the paper. All lender and foundation info along with CAI President Ron Stephens’ audio on foundation, and the denial letters along with the worst rejection by HUD that I and some other underwriters have ever seen is available. One other thing, I didn't know this but my letter from HUD obviously wants the OIG investigation material, they also per FHA guidelines recommend that we expose these management companies. I will show you if you want. Really, it does. That is refreshing! Especially with the attorney general ignoring that. His mortgage task force should be all over you UNTOUCHABLES.
I would like to thank Harvella Jones and Steve S. Harvella has been more than kind in helping this concerned citizen. And Steve has been very kind with his time. Maybe the seller and buyer will invite them to the next HOA meeting that is coming up. Don’t forget the refreshments and sign in sheet. By the way, make sure you bring those broad powers as well. Senator, why don't you come to the meeting and read the special provisions in our contract. The lender didn't have a problem with them. And even if they did, you can have an addendum. Good luck with explanations and I wouldn't be real quick to let your CAI buddies foreclose on this 80 year old homeowner who needs his money to pay for the assisted living costs for his wife, and by the way he is a veteran. The Buyer's rejected 3 different times because of the property and then HUD won't allow FHA financing. And now Countrywide gives up--it’s everything--Ineligible Property. CCR's. None of this is due to the Buyer or Seller. I think they deserve at least an apology. Maybe the CAI will look into it before someone goes to Jail. Harvella, you are the true Advocate.
CCMC's website just isn't true, the CAI’s scam website, they shouldn't even have a website, but the buyer is going to turn them into themselves to see what happens, that is to prove that they won't do a thing, and we will forward all of this to the OIG. I think they have been waiting to catch the crooked politicians with their self-serving interests. They can have the "UT Connection". Senator, you should really have a talk with Riddle and Williams with regard to Mr. Crosier, that family is really going through a hard time. They need their money, and let them know how you and David plan on fixing these CCR's. A responsible Management Company wouldn't let it happen. This would not have happened in 1992. So, therefore, it is your legislation that has allowed the BOD and management company to do evil. I will play you a message from their daughter cryng because they (Buyer and Seller) have done everything and Mr. Gibbons has done nothing. Mr. Crosier's phone number is 206-437-4349. The Buyer is too distraught to write her own letter. She has got to work and CCMC better get with her pretty quick.
Concerned Citizen. 214-870-2876 any one with help call or E mail. I don't expect America's Advocate (CAI) to step up, Why? They are untouchable! Riddle and Williams and Gibbons and Carona and the AG of TX are the CAI. Otherwise the State would help. The Texas Attorney General cannot because it would be a conflict of interest for him and his CAI scamming UT connection buddies. I guess I will have to start notifying all of the FHA leinholders (investors) in all CCMC communities. The buyer or I or seller has not heard back from anyone with regard to the CCR’s that are worthless here.
